2. Information we collect

We aim to collect only the information reasonably necessary to operate our website, deliver downloads, and support our services.

  • Information collected automatically: IP address, browser type, device and connection information, requested pages, timestamps, diagnostic details, and security-related request information.
  • Information you provide directly: if you email us, we may receive your email address, name, and any information you include in your message.
  • Game-related local data: our games may store local settings, saved data, preferences, and EOS Device ID sign-in information on your device when online multiplayer is enabled.

3. How we use information

  • Operate and maintain our websites and game services
  • Deliver downloads and updates
  • Maintain security, detect abuse, and troubleshoot issues
  • Respond to questions, feedback, and support requests
  • Improve website performance and reliability
  • Comply with legal obligations when required

We do not sell personal information and we do not use personal information for targeted advertising.

4. Hosting, delivery, and website analytics

Our websites and downloadable game files are delivered using services provided by Cloudflare, including Cloudflare Pages, Cloudflare R2, content delivery, and security tooling.

Our website also uses Cloudflare performance and traffic monitoring features, including Real User Monitoring (RUM) and/or Cloudflare Web Analytics, to help us understand site performance, reliability, and aggregate visitor activity.

Based on our current setup, this analytics tooling is intended to be privacy-focused and not used for behavioral advertising. We do not intentionally use Google Analytics, Meta Pixel, or similar advertising trackers on this site unless we update this policy.

5. Cookies and similar technologies

Our websites may use essential cookies or similar technologies provided by Cloudflare for security, performance, and site functionality. These may include security-related cookies used to protect the site from abuse and malicious traffic.

Cloudflare analytics features used on this site are intended to provide traffic and performance information without advertising profiling.

You can manage or block cookies through your browser settings, although some website functionality may be affected.

6. Game downloads and software

When you download a game from our website, our hosting infrastructure may process technical request data needed to deliver files, maintain performance, and troubleshoot errors. Downloading a game from our site does not, by itself, require you to create a Bad Idea Gameworks account.

Unless specifically disclosed otherwise, local game save files and settings remain on your device and are not automatically transmitted to us.

7. Online multiplayer and Epic Online Services

Last One Out is being developed with online multiplayer functionality powered by Epic Online Services (EOS). The following describes the planned data processing when players use those online features. The exact features available depend on the game version.

Account-free sign-in: Players will not need an Epic Games account for this multiplayer mode. The game uses the EOS Connect Device ID authentication method to establish a service-specific player identity. This process can create and retain a device-associated sign-in credential locally and uses an EOS Product User ID (PUID) to identify a player within the game's online services. This is distinct from an Epic Games account or Epic Games display name.

Information used for online play may include:

  • The EOS Device ID authentication credential and Product User ID needed to identify and authenticate the player for EOS Game Services.
  • The player's chosen in-game display name and relevant game or lobby settings.
  • Lobby discovery and membership information, connection status, and multiplayer match information.
  • Technical connection information, including IP addresses and network diagnostics processed as needed to establish connections, support relay networking, prevent abuse, and resolve errors.
  • Game state and gameplay synchronization messages exchanged during a match.

Other players and hosts: Your chosen display name, lobby membership, and certain game or lobby information may be visible to other players. In player-hosted matches, the hosting player's computer receives gameplay and networking information required to run the match. The information visible to other players or hosts can depend on the game version and network connection method.

Why this information is used: We use or enable the processing of this information to authenticate connections, create and locate lobbies, join and host multiplayer games, synchronize gameplay, maintain security, and troubleshoot online services.

Third-party processing: EOS is operated by Epic Games. Epic may process information as an independent service provider or controller according to its applicable terms and privacy practices. For information about Epic's own processing, review the Epic Games Privacy Policy.

Features not currently included: This planned multiplayer model does not require Epic Account Services login, Epic account profile access, or Epic friends-list access. Additional services, such as voice chat, may require updated disclosures before they are introduced.

8. Sharing information

We may share information with service providers only when reasonably necessary to host our site, deliver downloads, provide online services, maintain security, or respond to legal obligations.

We may also disclose information where required by law or where reasonably necessary to protect our rights, users, or services.

9. Data retention

We retain information under our control only as long as reasonably necessary for support, security, troubleshooting, dispute resolution, and legal compliance. The period depends on the category of information and why it is needed.

Locally stored game preferences, saved data, and EOS Device ID sign-in information may remain on a player's device until removed by the player, the game, or the relevant service. Deleting local game data may affect access to an existing device-linked player identity.

Cloudflare and Epic Games may retain infrastructure, security, and service records according to their own policies and retention schedules. We cannot guarantee that clearing local game files deletes information held by those providers.

10. Security

We take reasonable steps to protect information against unauthorized access, loss, misuse, or alteration. Our websites use HTTPS and security protections provided through our hosting infrastructure. No internet transmission or storage method is completely secure, so we cannot guarantee absolute security.

11. Children's privacy

Our websites and games are not specifically directed to children under 13. We do not knowingly collect personal information directly from children under 13 without appropriate authorization or another lawful basis. If you believe a child has provided us information inappropriately, please contact us and we will review the request.

12. Your privacy rights and data requests

Depending on applicable law, you may have rights to access, correct, delete, or restrict certain processing of personal information we maintain about you. To make a request, email [email protected] and describe the request and the game or service involved.

For requests concerning Last One Out multiplayer, you may provide your in-game display name and, if available, your EOS Product User ID to help us locate relevant information. Never email passwords, Client Secrets, or authentication tokens. We may need to verify a request before acting on it.

We will review requests concerning information under our control and, where applicable, work with service providers or explain how to contact them for information held independently. Epic Games also provides its own privacy request procedures through its privacy policy.

13. External links

Our websites may link to third-party websites or services. We are not responsible for the privacy practices, content, or security of third-party sites, and we encourage you to review their privacy policies separately.

14. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our website, games, services, or legal obligations. When we do, we will update the effective date on this page.
